சிவில் பிரச்சனையில் போலீசார் தேவையின்றி விசாரிக்கக்கூடாது - ஏடிஜிபி அருண் சுற்றறிக்கை

சிவில் பிரச்சனைகளில் போலீசார் தேவையில்லாமல் தலையிடக்கூடாது  என  தமிழ்நாடு காவல்துறையின் சட்டம் ஒழுங்கு ஏடிஜிபி அருண் சுற்றறிக்கை வெளியிட்டுள்ளார்

எஃப்.ஐ.ஆர், சி.எஸ்.ஆர், நீதிமன்றத்தின் வழிகாட்டுதல் உள்ளிட்டவை இன்றி எந்தவொரு மனுக்கள் மீதும் காவல்துறை எந்த விசாரணையும் நடத்தக்கூடாது எனவும் பணத்தகராறு, சொத்துத்தகராறு, வழித்தட தகராறு போன்ற சிவில் விவகாரங்களில் தலையிடுவதை தவிர்க்க வேண்டும் எனவும் ஒருவேளை சட்டம் ஒழுங்கு பிரச்னை ஏற்படும் என்ற ரீதியில் விசாரிக்க வேண்டுமென்றால் CSR / FIR பதிவு செய்த பின்னர் தான் விசாரிக்க வேண்டும் என தெரிவித்துள்ளார்

இது தொடர்பாக ஏடிஜிபி அருண் அவர்கள் வெளியிட்டுள்ள சுற்றறிக்கையில்:-

எப்.ஐ.ஆர், சி.எஸ்.ஆர் மற்றும் நீதிமன்ற வழிகாட்டுதல் உள்ளிட்டவை இன்றி எந்த ஒரு மனுக்கள் மீதும் காவல்துறை விசாரணையும் நடத்தக் கூடாது. 

பணத்தகராறு, சொத்து தகராறு, வழித்தட தகராறு போன்ற சிவில் விவகாரங்களில் தலையிடுவதை போலீசார் தவிர்க்க வேண்டும்.

சிவில் விவகாரங்களில் தலையிடுவது அவசியம் என கருதினால் மாவட்ட எஸ்.பி அல்லது காவல் ஆணையர்களிடம் அனுமதி பெற வேண்டும். 

உரிய ஒப்புதல் இன்றி விசாரணை மேற்கொண்டால் சட்ட விரோதமாக கருதப்படும், ஒழுங்கு நடவடிக்கையும் எடுக்கப்படும் என்று அந்த சுற்றறிக்கையில் கூறப்பட்டுள்ளது.

officers are conducting enquiry on petitions which are purely civil in nature, like money dispute, land dispute, property dispute, path way dispute, intellectual property dispute, etc.. These civil matters are the domains of civil courts. Police should not interfere unnecessarily in these civil matters, except in matters where law and order issues are anticipated.

2) In this regard, the following instructions are issued:-

i. There should not be any enquiry by the police on any petitions without assigning a CSR/ FIR, or Current Paper endorsed by superior officers, or direction by the Courts.

ii. Police should strictly refrain from enquiring or interfering in civil matters like money dispute, land dispute, property dispute, path way dispute, intellectual property dispute, etc..

iii. If the Police officer feels that it is absolutely necessary to conduct enquiry or intervene in civil matters, due to anticipated law and order issues, the concerned officer should obtain permission from the Superintendents of Police in Districts and Commissioners of Police in Cities. Without the personal endorsement of SP/COP, any petition enquiry on civil matters by any Police Officer will be consider illegal and will attract disciplinary action.

3) All the unit officers are instructed to follow these instructions without any deviation.
